Terms and Condition

1.0 Introduction and Acceptance of Agreement

1.1 Thank you for choosing Ashirwad Holidays. We take all efforts to make sure that you have a delightful holiday experience. To avoid any misunderstanding, we request you to read, understand and abide by the below ‘Terms and Conditions’ along with Privacy Policy before you book any tour or holiday or any service or make any transaction with Ashirwad Holidays at any of the Ashirwad Holidays sales offices or at sales partner or online on Ashirwad Holidays’s website or any mobile application or otherwise. Once you book any tour or service with Ashirwad Holidays, it is understood that you are giving your unqualified consent to accept and abide by the ‘Terms and Conditions’. In case you disagree with any part of these ‘Terms and Conditions’, kindly do not proceed with the booking.

1.2 ‘Terms and Conditions’ extend to all group tours, customized holidays, corporate tours, any other services and products for Domestic, International or Inbound organised by ‘Ashirwad Holidays Private Limited’.

1.3 Ashirwad Holidays has the final authority on the interpretation of these ‘Terms and Conditions’.

1.4 Ashirwad Holidays reserves the right to amend, vary, add, amplify or waive any stipulation, representation, term or condition mentioned in the ‘Terms and Conditions’.

1.5 Under any unprecedented force majeure situation or any changes in Government policy, Ashirwad Holidays reserves the right to supersede any part of these ‘Terms and Conditions’ with an alternate and valid enforceable provision.

1.6 Each of these ‘Terms and Conditions’ shall be severable and if any provision thereof is declared invalid, illegal or unenforceable, then remaining provisions nevertheless shall have full force & effect.

1.7 These ‘Terms and Conditions’, together with the other booking related terms/ communication sent periodically, represent the entire agreement between Ashirwad Holidays and you.

1.8 There is no agreement between the Company and you until the company has received the initial registration amount/ deposit as the case may be.

2.0 Description

2.1 These ‘Terms and Conditions’ be called, Ashirwad Holidays Private Limited Terms and Conditions’ or ‘Ashirwad Holidays Terms and Conditions’.

2.2 These ‘Terms and Conditions’ may also be referred as ‘Rules and Regulations’.

2.3 Ashirwad Holidays Private Limited will be hereinafter referred as ‘Ashirwad Holidays’, ‘AH’, ‘AHPL’, ‘the Company’, ‘the organization’, ‘we’, ‘us’ or ‘our’ and its user will be hereinafter referred as ‘Guest/s’, ‘them’, ‘they’, their, ‘You’, ‘Your’, ‘tourist/s’, ‘traveller/s’, ‘client/s’, ‘customer/s’, ‘pax’, or ‘passengers’.

2.4 The website and the mobile applications of Ashirwad Holidays are collectively referred to as ‘Website’.

3.0 Definitions

3.1 ‘Ashirwad Holidays Private Limited’ works under the brand name ‘Ashirwad Holidays’, therefore, both these names will be considered one and the same and used synonymously therein.

3.2 ‘Website’ means www.ashirwadholidays.in and ‘Web page’ means a page on the Website www.ashirwadholidays.in.

3.3 ‘Brochure’ means a document with tour information in the form of printed brochure, E-brochure, E-itinerary, leaflet, booklet, travel planner, Tour Price list, Tour Information Email etc.

3.4 ‘Itinerary’ means a detailed plan for a journey with a list of places to visit; plan of travel, a book describing a route or routes of travel with information helpful to travelers and always subject to Force Majeure Situation.

3.5 ‘Tour’ means any Domestic/ International/ Inbound Tour organized by Ashirwad Holidays.

3.6 ‘Group Tour’ means number of guests booked on any scheduled tour comprising minimum 15 guests for Indian tour and 20 guests for international tour.

3.7 ‘FIT’ means Free Independent Travel and ‘GIT’ means Group Inclusive Tour.

3.8 ‘Corporate Tour’ means a special tour designed for corporates, industries, institutions, independent organisations, ad-hoc groups or individuals to facilitate their meetings, incentives, conferences, exhibitions, seminars, team building and other events. This segment is also known as MICE i.e. Meeting. Incentive. Conference. Exhibition.

3.9 ‘Customized Holiday’ means a tailor-made holiday designed as per the requirements of an individual guest. This segment is also known as FIT.

3.10 ‘Inbound’ or ‘India Inbound’ means tours, packages or any service provided to foreign nationals or non-resident Indians to explore the states of India and the Indian Subcontinent.

3.11 ‘Speciality Tour’ means tour designed to meet special interest of travellers which include but not limited to Ramayana Tour, Jyotirlinga Tour, Shaktipith Tours, North India Divya Desham Tour, Honeymoon Special, Women’s Special, Seniors’ Special, Singles’ Special, Short Trips, Cost Saver, Festival Tours, Adventure Tours, Trekking Tours etc.

3.12 ‘Sales Partner’ means Ashirwad Holidays’s authorized travel agent who possess the requisite licenses, permissions, expertise and infrastructure to sell the tour/s organised by Ashirwad Holidays to all the prospective guests. These include sales channels such as PSPs i.e. Preferred Sales Partners; KSPs – Key Sales Partners, OSP – Overseas Sales Partners and franchisees.

3.13 ‘Independent Contractor’ means a person and/or organization selected by Ashirwad Holidays to render services including transport, hotel, air, insurance, restaurant, sightseeing to the guest/s and/or to Ashirwad Holidays. Independent Contractor is not an employee, partner or joint venture of Ashirwad Holidays.

3.14 ‘Travel Advisor’ means Ashirwad Holidays’s authorized sales person who assists and guides guests on booking their Ashirwad Holidays tour/service.

3.15 Associate/ Destination Management Company (DMC) / Contractor/ Supplier/ Vendor means a service provider of a tour or package which includes but not limited to airline, cruise, railway, road transport, hotel, restaurant, caterer, sightseeing attraction, entertainment park etc.

3.16 ‘Tour Manager/ TM / Tour Leader/ Tour Escort / Tour Assistant, is a person designated by Ashirwad Holidays to conduct the tour as per the itinerary. S/he will also assist or guide the guest/s during the tour.

3.17 ‘Guest/s’ means all the tourists, travellers, vacationers, sightseers, visitors, backpackers, customers, clients who have registered their names or enquired about tour/ package or booked the tour by making part or full payment for any scheduled tour, customized package or any other travel related service provided by Ashirwad Holidays.

3.18 ‘Gender’ – The masculine gender shall also include feminine gender and vice versa, the singular shall include plural and vice versa and shall include grammatical variations if any.

3.19 ‘Tour price’ means the price mentioned in the Tour Price Grid on the website/ mobile application/ sms/ email/ Whatsapp/ brochure / E-brochure/ leaflet/ advertisements on print, electronic and social media etc. which is to be paid by guests for booking the tour. Taxes, surcharges, if any, are payable over and above the Tour Price.

3.20 ‘Child’ means a guest who falls below the age of 11 years.

3.21 ‘Infant’ means a guest who falls below the age of 2 years.

3.22 ‘Extra bed’ or mattress means an additional roll-on mattress on floor in twin/ double bed room.

3.23 ‘Surcharge’ means an additional fee/ charge/ tax over and above the initially quoted tour price which is due to peak season/ special event, charged by the associates/ suppliers/ contractors/ tourism or government authorities.

3.24 ‘Peak Season’ and ‘Super Peak Season’ are the seasons of the year where the demand surpasses the supply which results in overall cost increase. This includes but is not limited to Summer Vacation, Diwali Vacation, Christmas Vacation, New Year Holidays, any Country Specific Vacation/ Festival or National/International Events etc.

3.25 ‘First Day/ Last Day/ Day’ of the tour shall start at any time (i.e. in the morning / afternoon / evening /night/ midnight) at the first destination depending on the arrival of the respective flight, train, bus  or any other mode of transport and the same shall be in case of the last day of the tour. In other words, a ‘Day’ of the tour shall mean a part of the day or 24 hours or its part thereof.

3.26 ‘Meal Service’ on tour comprise of pre-set breakfast (B)/ lunch(L)/ dinner(D) and/or any other snack and mineral water bottle as mentioned in the itinerary.

3.27 ‘Jain Meal’ on tour means food without onion & garlic served at Lunch and Dinner as per the tour itinerary, not necessarily before sunset. It may be a buffet service or a table service.

3.28 ‘VISA’ means ‘Visitor’s International Stay Admission’ is a conditional authorization granted by the immigration authorities of a territory to foreigners allowing them to enter, remain within, or to leave that territory for a specified period of time. This is in the form of a paper authorisation or a stamp/sticker endorsed on the applicant’s passport. Ashirwad Holidays is a facilitator and does not have any role in the granting / rejecting of the Visa.

3.29 ‘Force Majeure’ means an event or circumstance not within the control, directly or indirectly, of Ashirwad Holidays in its ability to perform its obligations/ responsibilities regarding the tour, including

  • war, hostile invasion, act of foreign enemies;
  • rebellion, revolution, terrorism, insurrection or civil war;
  • political unrest, government orders, riots, commotion, disorder, curfews, strikes, lockouts etc.;
  • any act or omission of any government instrumentality;
  • a change in legal requirements;
  • infectious diseases, epidemic, pandemic;
  • explosion, fire, flood, drought, tsunami, earthquake, volcanic eruption, hurricane, tempest, typhoon, cyclone, snowstorm, thunderstorm, landslides and other exceptional natural calamities and acts of God;
  • ionizing radiation or contamination by radioactivity from any nuclear fuel/ waste or radioactive toxic explosive of any nuclear assembly;

3.30 ‘Cancellation Policy’ means a policy laid down in Ashirwad Holidays’s ‘Cancellation Policy’ wherein applicable cancellation charges are specified which are to be borne by the guests on cancellation of their tour.

3.31 ‘Cancellation Charge’ means a charge borne by the guest upon cancelling their tour for any reason whatsoever.

3.32 ‘Refund’ means repayment of the sum of money to the guest paid by him/her at the time of booking the tour after deducting the applicable cancellation charge.

3.33 ‘Future Tour Voucher’ (FTV) means a credit voucher of a specified value issued by Ashirwad Holidays on cancellation of the tour. FTV must be utilized by the guest/s for booking their future tour with Ashirwad Holidays within the specified period and as per the agreed terms indicated in the said FTV.

3.34 ‘Tour Transfer Charge’ (TTC) means ‘estimated maximum charge’ that the guest may have to pay if their booked tour is being postponed due to the occurrence of certain unavoidable / Force Majeure situation.

3.35 ‘Operational Expense’ means expenses that Ashirwad Holidays has to incur through its normal course of business to conduct its tours and business operations.

3.36 ‘Jurisdiction’ means the geographical area over which a court or government body has the power and right to exercise authority. For any legal matter involving the company, parties hereto agree to confer exclusive jurisdiction to Gorakhpur (Uttar Pradesh) Courts / Forums.

4.0 Booking

4.1 Booking of Group Tour, Customized Holiday, Corporate Tour, Inbound and any independent service through Sales Channels or Online through website/ mobile app:

a) Any guest who enquires about or purchases any product offered by Ashirwad Holidays through its website, mobile application, branch office, sales office or call centre agrees to enter into a contract with Ashirwad Holidays. A contract is said to have been executed by both the parties i.e. Ashirwad Holidays and the guest. Once a contract is executed, both the parties are bound by the ‘Terms and Conditions’ mentioned on Ashirwad Holidays’s website/ travel planner/ brochure/ booking form.

b) When a guest books the product/ service offered by Ashirwad Holidays, provides his/her information and consent for initiating the booking and thereafter makes the payment of registration amount, indicates that the guest is interested in the tour and has read, understood and accepted all the ‘Terms and Conditions’ mentioned on Ashirwad Holidays website/ travel planner/ brochure / booking form.

c) In case, the booking formalities are processed by the guest on behalf of his/her family, s/he is deemed to have been authorized to do so by his family members after reading, understanding and

accepting all the Ashirwad Holidays ‘Terms and Conditions’ mentioned on the website/ travel planner/ brochure / booking form.

d) A guest must be eighteen (18) years or above to make a booking with Ashirwad Holidays.

e) A guest must ensure that all the information provided by him/her while filling the booking form is accurate, as booking is processed based on this information. In case of any incorrect information, the loss or cost incurred for amendment will be borne by the guest.

f) Ashirwad Holidays reserves the right to accept or to decline any booking of any person/s or cancel the booking without assigning any reason.

4.2 Customized Holiday Booking:

Ashirwad Holidays offers flexibility to the guests who do not wish to opt for the readymade holiday itineraries available on the website. Our Travel Advisors assist such guests to create their customized tailor-made holiday as per their requirement and interest. A non-refundable Itinerary Design Fee (IDF) of INR 1000 for Domestic and INR 2500 for International must be paid at the time of enquiry. IDF will be adjusted in the booking amount if the holiday is booked within 25 working days from the date of receiving the same. IDF includes only three free amendments in the itinerary.

4.3 Traveller’s Information Form (TIF)

After booking the tour packages with Ashirwad Holidays, primary passenger is required to fill Traveller’s Information form, which is the reference document for us after booking. We compare the final quote with the data you filled in TIF, because this gives us clarity of your understanding on tour plan, inclusions, exclusions & final price. Any ambiguity in this will delay the process of your booking & our operations team will proceed with the booking only after the complete clarity. So, you are requested to kindly fill the TIF very carefully & avoid the chances of any delay in booking.

4.4 Communication with the Guest:

Any communication by Ashirwad Holidays will be made through e-mail, WhatsApp, sms, telecall etc. on the registered legitimate contact details provided on the booking form by the guests and shall be deemed to have been communicated to and received by the guest. Guest’s must ensure that number is valid and messages are checked periodically. Ashirwad Holidays is neither a mobile network operator nor internet service provider and hence does not guarantee the delivery of sms-text messages/ WhatsApp messages/ email. The guest will indemnify Ashirwad Holidays for any action taken by TRAI due to a wrong number/ email provided by the guest for any reason whatsoever.

4.5 Physical and Mental Fitness:

When a guest books the tour or when someone else books the tour on their behalf, it implies that the guest is physically and mentally fit to travel to the particular destination. It is crucial for the guest/s to maintain their health throughout the tour and carry any required medication with a doctor’s prescription. Ashirwad Holidays reserves the right to decline the booking or discontinue the guest from the tour if the guest is found unfit to travel, or if their medical condition is causing inconvenience to fellow travellers in the group tour. Any expenses due to health issues arising during the tour shall be entirely borne by the guest, and we shall not be held responsible in any manner whatsoever. Additionally, guests are advised that high-altitude locations in the tour itinerary may pose challenges for any individual irrespective of their age and otherwise normal health condition. Further, Minors, Senior citizen and guest with per-existing medical condition, must consult with their doctors before booking
any tour, especially before booking the high-altitude destination tours, to ensure a safe and enjoyable experience.

4.6 Mandatory Health Requirement:

Guests must abide by the mandatory requirements for travel to the destination, such as Vaccination, RT-PCR tests, RAT, e-pass formalities, health checks on arrival/ on tour etc. as per the state or country. These requirements or regulations are subject to change periodically. Any cost incurred for such requirements should be borne by the guests. It will be the sole responsibility of the guest to carry the certificate or test report with them and present it whenever asked for by the officials. Any State or Country or service provider such as Airline, Hotel, Cruise Company, Railway may decline the entry to a guest/s on medical grounds in such situation the consequences including all kinds of expenses will be borne by the guest.

4.7 Travel During Pregnancy:

Ashirwad Holidays does not recommend travel during pregnancy. The Company does not provide any specialized facilities and/or treatments required for childbirth, prenatal, or early infant care on tour. Guest should consider the risks of traveling where necessary medical care for pregnancy may not be available and may not be reachable in a timely manner to address potential medical complications, problems, and emergencies that can occur during pregnancy.

5.0 Tour Price, Tour Registration, Payment

5.1 To book any tour/ package/ service, guest must make the payment to Ashirwad Holidays by Demand Draft, NEFT, RTGS, IMPS, Payment app/ wallets like BHIM, PhonePe, Gpay, PayTM or any UPI ID. All payments should be in the name of ‘Ashirwad Holidays Private Limited’ only. We support ‘Go Digital’ movement of India and request our guests to make digital payments. Cash payment in INR will be accepted as per the Government of India guidelines along with PAN. Kindly note, outstation cheque is not accepted.

5.2 In case of payments made using Credit Card, Debit Card and Online Transfer, convenience charge of 2.5% shall be levied and will be paid extra by the guest.

5.3 Tour price does not include government taxes and are to be paid extra. As per government’s current regulations, 5% GST (Goods and Services Tax) is applicable on every tour/package and guests will have to pay the same over and above the tour price.

In addition to this, effective from 1st October 2020, government has levied TCS (Tax Collected at Source) on GST inclusive tour/package price of international/overseas travel packages. From 1st October, 2023, The TCS rate is either 5% or 10% up to 7 lacs (% is determined on travellers ITR verification on the government portal) and 20% on amounts above 7 lacs depending on certain requirements.

Those guests who have submitted PAN copy, Aadhaar copy and have filed their Income Tax Returns (ITR) for previous two assessment years need to pay 5% TCS up to 7 lacs billing. Those guests who do not possess PAN and Aadhaar or have not filed their Income Tax Returns (ITR) for previous two assessment years, will have to pay 10% TCS up to 7 lacs  billing. In case of billing above 7 lacs, guests will have to pay 20% TCS.

The TCS collected can be claimed while filing annual income tax returns. The TCS amount will reflect in the Form 26AS of the guest whose PAN card is associated with the booking form, irrespective of the person who has made the payment for the tour/package. Hence while booking

guests must ensure that the right PAN card is submitted in order to claim the benefit at later stage. Once the TCS amount is collected from the guest, it cannot be refunded by Ashirwad Holidays, as it is paid to government and reflects against the Form 26AS of the guest.

The TCS is not applicable in case of corporate/Individuals who possess valid TAN (Tax deduction & collection account number) and provide the same at the time of booking/confirmation of tour/package. Further upon submission of TAN, the Corporate/Individual needs to comply with TDS rules and ensure that TDS is paid in the name of Ashirwad Holidays Private Limited (PAN: AASCA6566C, TAN : ALDA05143F).

5.4 Registration Amount – A tour/package registration amount of 10% of the total tour price is required. This amount must be paid within three days of verbal/written consent of booking the tour/package. Registration Amount is the guarantee of NO PRICE change (Except for services which has dynamic fare such as Airlines and others) of the services you booked with us, subject to your adherence with the payment terms.

Payment of registration amount ensures only registration/ participation in the tour and does not entitle to the guest of any services like air tickets, visas, and hotel accommodation until full payment for the tour has been made by the guest and received by Ashirwad Holidays.

5.5 Advance Payment – is the minimum commitment amount we need to book the service offered to you which is minimum 25% of the total package cost & 100% of the flight / cruise ticket / other auxiliary services booking.

For any reason if the advance amount (is not paid in full at the time of booking, guest will ensure that the balance advance amount is paid within 3 days of booking ; else booking stands cancelled.

5.6 The Advance Payment paid at the time of booking is non-refundable and interest free, subject to the Cancellation and Refund Policy. Advance payment amount differs from tour to tour. For tours where air or cruise booking is required, the registration amount will be higher compared to other tours.

5.7 As per payment guidelines stated on ‘www.ashirwadholidays.in’ tour price must be paid in full, 07 days before the tour departure (Or as per agreed payment plan); in case if tour is booked within 07 days of the departure date, guests must make full payment of the tour price at the time of booking itself. If the payment plan is not followed by you, the company reserve the right to cancel the booking any time & forfeit the amount paid till date & which cannot be claimed in any case. Company also reserves the right to impose the Cancelation policy & claim its money in such cases.

5.8 All payments made by the guest to Ashirwad Holidays become the property of Ashirwad Holidays and are used to pay our suppliers, contractors, and associates for pre-booking and securing services, as well as to cover the company’s operational costs. Guests acknowledge and agree that these funds are not held by Ashirwad Holidays on behalf of the guest.

6.0 Documentation

6.1 Documents required for booking the tour.
a) For domestic tours, guests are required to have a valid photo ID, and for international tours, a valid passport is necessary. According to RBI regulations, submission of a PAN card is mandatory for both domestic and international tours. Guests must also provide all required documents as specified by the visa consulate or embassy relevant to their travel.

b) It is the guest’s responsibility to ensure they possess all necessary travel documents and statutory clearances, such as passports, visas, confirmed air tickets, travel insurance, and any required medical or legal certificates.

c) If a guest does not have the required documents or fails to submit them within the specified time, the booking will be cancelled, and applicable cancellation charges will apply.

6.2 Photo Identification :

For domestic tours within India, all guests must carry a valid photo ID, such as an Aadhar card, election ID card, PAN card, driving license, or school/college ID for students. This ID may be required at airports, railway stations, certain sightseeing locations, safari parks, border areas, and other specific sites. Guests must present these IDs upon request from officials at any time during the tour. But, in case of international tour Passport is must, no other ID card is valid or acceptable.

6.3 Passport : Before booking for any international tour, it is guest responsibility to check & confirm the Passport Rule, if the passport is valid to travel in that country then only guest should enquire about the tour packages & ask us for quote, If guest fails to do so & book his tour paying registration amount / advance payment, this amount will neither be refunded OR adjusted against any further / future tours.

6.4 VISA : Visa is a mandatory authorization issued by the consulate that permits the guest/s to enter their country for a limited period of stay. For any international travel guest/s must have a valid VISA. Ashirwad Holidays is NOT responsible for any VISA related issue with embassy / consulate, it should be directly dealt by guest & Ashirwad Holidays is never be made party in such event.

6.5 Travel Insurance
a) Every domestic / international traveller is advised to must have travel insurance. They should buy it directly OR can ask the company to buy for them.
b) These insurance has a limited cover which includes loss of baggage, flight delays/ cancellation, hospitalization, death, repatriation, evacuation etc. to a certain extent. Few adventure activities which are part of the tour itinerary may or may not be covered in the insurance policy.
c) Overseas travel insurance policy is at the sole discretion of the respective insurance company. Ashirwad Holidays is just a facilitator (in case policy is purchased from us) who does not have any control over their operations or the claim process. Guests will have to directly communicate with the insurance company and provide necessary documents asked for the claim settlement. Any grant or rejection of the claim will be solely the decision of the insurance company and Ashirwad Holiday is not responsible for the same. Any dispute arising about adequacy of settlement amount or rejection of claim should be directly dealt with the Insurance Company by the guests.
d) Foreign nationals or NRI guests arriving in India on an Inbound Tour or any Group Tour, need to purchase their travel insurance separately on their own before starting the journey.

7.0 Tour Itinerary

7.1  Ashirwad Holidays strives to operate tours according to the original itinerary as much as possible. However, the itinerary provided at the time of booking or mentioned on our website, brochures, or leaflets is based on information available at that time and may change due to factors such as state or country regulations, transport arrangements (airline, cruise, rail, road), hotel availability, or sightseeing adjustments.
7.2  Ashirwad Holidays reserves the right to modify, alter, or amend the itinerary either before the tour departure or during the tour itself. Guests will be informed of any changes via email, SMS, call, or by the Tour Manager while on tour.

7.3 Changes to the original itinerary may occur due to unforeseen events such as force majeure, festivals, sporting events, weather conditions, traffic issues, cancellations or re-routing of flights/cruises/rail services, overbooking or closure of hotels, or closure of sightseeing attractions. In such cases, any additional costs arising from these changes will be the responsibility of the guest.

7.4 To enhance the tour experience, Ashirwad Holidays may add, remove, or replace certain sightseeing attractions or services. Should these modifications result in extra charges, they will be borne by the guest.

7.5 Any unforeseen incidents during the tour may result in changes to the itinerary.

7.6 Booked tours, packages, or services that include flights, helicopters, seaplanes, cruises, ferries, etc., are subject to availability, weather conditions, local permissions, and other statutory requirements. Ashirwad Holidays is not responsible for any operational issues under such circumstances. If necessary, we reserve the right to substitute the advertised product, service, or sightseeing location with a suitable alternative. The company is not liable for any damages, additional expenses, or consequential losses suffered by the guest as a result.

7.7 Guests should be aware that itinerary changes are often beyond our control, and Ashirwad Holidays will not be liable to pay any compensation or damages for such changes.

8.0. Baggage and Belongings

8.1 Guests are advised to travel light, avoid carrying valuables, and take utmost care of their baggage and personal belongings at all times during the tour. Items such as mobiles, cameras, laptops, jewelry, gadgets, passports, visas, tickets, currency, purses, and bags should not be left unattended. We recommend using digital payment methods like forex cards, credit cards, mobile payments, and e-wallets. Guests are solely responsible for the safety of their belongings. Ashirwad Holidays and its representatives are not liable for any loss, theft, damage, or accident involving personal items during flights, coach travel, hotel stays, or at sightseeing locations, regardless of the cause.

8.2 In the event of loss, theft, damage, or an accident involving personal belongings, it is the guest’s responsibility to report the incident to the relevant local authorities, such as the police, airline offices, or other concerned entities, and to follow up directly with them.

8.3 Any claims regarding loss, theft, damage, accidents, or negligence involving third parties like airlines, hotels, coach companies, or sightseeing venues should be addressed directly with those entities or the guest’s insurance provider (if applicable). Ashirwad Holidays is not liable for disputes regarding settlement amounts or claim rejections from third parties or insurance companies.

8.4 Guests should be aware of customs, immigration, and airline restrictions on certain items and the amount of currency allowed during travel. Guests must comply with these regulations. Carrying restricted items, excessive currency, or misplacing passports may lead to detainment, missed flights, or tour disruptions. Ashirwad Holidays is not responsible for any losses or additional expenses that arise from such situations.

9.0 Accommodation on Tour

9.1 General:

The type of accommodation provided on a tour depends on the specific tour package and may include resorts, hotels, houseboats, tents, camps, dormitories, hostels, cruises, trains, coaches, and more. The location and type of accommodation generally align with the tour itinerary. Suggested hotel names or types mentioned in the tour program are subject to availability, and similar tours may use different accommodations based on capacity and availability at each destination. Please note that hotel membership rewards or points cannot be earned or redeemed for bookings made through Ashirwad Holidays.

9.2 Room Type/ Category:

Typically, rooms are twin, double, or single-bedded, with extra beds (if needed) provided as a floor mattress. The category of rooms are the first (basic) category of that particular hotel, however guests may upgrade to suites, family rooms, or rooms with specific views, subject to availability and at an additional cost.

In case of our group tours, rooms are provided on sharing basis & If any guest wishes to have a separate room, they may request this based on availability and pay the additional charge. Single rooms are often smaller and may be located on different floors or in specific areas of the hotel. Room assignments are made at the discretion of the hotel, associates, or service providers, and are beyond the control of Ashirwad Holidays.

9.3 Check-In and Check-Out Time:

Standard check-in times are typically 2:00 p.m., and check-out times are 11:00 a.m., both in India and internationally. Our itineraries are planned with these timings in mind. If guests arrive early, they may need to participate in scheduled sightseeing activities before checking in. Guests who wish to check in early or check out late may do so by paying an additional charge, subject to availability. Some accommodations may request a credit card or security deposit at check-in, refundable upon check-out based on the services utilized.

9.4 Room Sharing:

Solo guests who share a room with another guest must adhere to Ashirwad Holidays’ room-sharing policies, which are provided upon booking. Any issues, such as misunderstandings or loss/damage of personal or hotel property, are the responsibility of the sharing guests and must be resolved between them. Ashirwad Holidays is not liable for these matters. If a room-sharing guest exhibits harmful, unhygienic, or intolerable behavior, they may be required to book a separate room at their own expense.

9.5 Children Sharing Room with Parents:

For convenience, it is recommended that a family of three book a double room with an extra mattress, and a family of four book two separate rooms. For safety reasons, most hotels do not allow four guests to share a single room.

9.6 Damage Caused to Property:

Any damages caused to hotel rooms or other accommodations must be covered by the guest and paid before check-out. If guests notice any pre-existing damage upon entering their room, they should report it to hotel staff or the Ashirwad Holidays Tour Manager immediately. Ashirwad Holidays is not responsible for such losses and will not cover these costs.

9.7 Accommodation Facilities:

Facilities such as parking, restaurants, bars, gyms, spas, swimming pools, sports activities, childcare, meeting rooms, business centers, travel desks, on-call doctors, elevators, porters, laundry services, Wi-Fi, mini-bars, air conditioning, in-room safes, room service, etc., vary by accommodation and are dependent on the tour or destination. These facilities may not be complimentary, and guests should confirm the terms before using them. Any charges incurred for using these services must be paid directly to the hotel. Ashirwad Holidays is not liable for any service disruptions, facility deficiencies, or unprofessional behavior of hotel staff, as these aspects are outside our direct control. Additionally, due to environmental conservation efforts, restrictions on water, electricity, and air conditioning may be enforced in some areas, and guests are expected to comply with these measures.

9.8 Accommodation in the Tropics/ Forests/ Open Air:

For accommodations located in natural environments, such as tents, camps, safari lodges, and beach resorts, guests may encounter insects like ants and cockroaches, as well as animals such as birds, monkeys, and small wildlife around the property. These encounters are typical of the local environment and should not be considered an indication of cleanliness issues.

10.0 Meals

10.1 Meals on the tour are provided as per the itinerary or tour program, with meal codes: B (Breakfast), L (Lunch), and D (Dinner). These meals are typically served as pre-set menus, often featuring Indian dishes, and may occasionally include local or international cuisine depending on the destination and tour. The Indian meal menu generally consists of dal, rice, roti, two vegetables,  salad and dessert.

10.2 Based on the tour program, packed meals may be provided at certain locations during the tour.

10.3 For group tours, special meal or dietary requests can be accommodated to a limited extent if notified at the time of booking. Guests with specific dietary requirements are encouraged to carry their own snacks, as it may not be possible to meet special requests at all locations.

10.4 If notified at the time of booking, Jain meals or meals without onion and garlic can be arranged for lunch and dinner as per the tour itinerary. Please note that these meals may not be served before sunset, and may be offered as a buffet or table service.

10.5 A standard baby meal typically includes milk, plain dal, and rice. We recommend that guests traveling with very young children bring their preferred baby food, as availability may vary.

10.6 Meals missed by the guest due to personal reasons will not be substituted or compensated.

10.7 While we make efforts to select quality restaurants for meals, we do not have direct control over their operations, including food preparation, hygiene, or sanitation. Ashirwad Holidays is not responsible for any deficiencies in the quality or service provided by these establishments, and no complaints or claims regarding this will be entertained.

10.8 Meal plan mentioned in our quote as EP, CP, MAP & AP, each of them are explained as below.

EP : European Plan – Which means you are eligible for Room Only, food is NOT included.
CP : Continental Plan – Which means you are eligible for Room With Breakfast Only.
MAP : Modified American Plan – Which means you are eligible for Room with Breakfast & either lunch Or Dinner, any one of these main meals only.
AP : American Plan – Which means you are eligible for Room with with all three meals of the day i.e Breakfast, lunch & Dinner.

Note : In all tours Meal plan start with check-in & check-out of your hotel. Mean, if you are on CP plan, breakfast will be served from Day-2 morning, breakfast on arrival day is never included & it will on guest.

In MAP plan guest’s meal start with Dinner of Day -1 & ends with Breakfast of Day last i.e at last day dinner is never included & it will be on guest.

In AP plan guest’s meal start with Lunch of Day -1 & ends with Breakfast of Day last i.e at last day lunch & dinner is never included & it will be on guest.

For clarity & better understanding, you can count your meals as per the number of nights you are staying at Hotel i.e if you have booked 04 Nights / 05 Days Plan so, in that case in CP you will be eligible of 04 breakfast only, in MAP you will be eligible for 04 Breakfast & 04 Dinner Only & in AP plan you will be eligible for 04 Breakfast, 04 Lunch & 04 Dinner Only.

11.0 Shopping

Shopping can be an enjoyable and memorable part of any tour. We encourage guests to shop responsibly and to carefully check the price and quality of items before making a purchase. Ashirwad Holidays does not endorse or promote any specific shop or vendor, and we are not responsible for any items you may choose to buy during the tour. In some cases, sightseeing locations may feature their own souvenir shops, flagship stores, or galleries where guests may shop if they wish, though there is no obligation to do so.

While shopping, we advise guests to verify the quality, quantity, and price of items and to be aware of VAT/GST refunds, baggage allowances, courier fees, shipping and freight charges, and any applicable customs duties.

12.0 Privacy of Information

12.1 Personal information provided by guests to facilitate booking is treated as confidential. Ashirwad Holidays may require guests to share personal details such as name, age, birth date, address, phone number, email, Aadhaar number, PAN, passport number, and other specific information like religion, health conditions, dietary preferences, and medical history. To arrange your travel, this information may be shared with consulates, embassies, visa services, tourism organizations, customs/immigration authorities, airlines, cruises, railways, hotels, destination management companies, marketing services, communication providers (SMS, email, WhatsApp), associates, partners, Tour Managers, and co-travelers (to a limited extent).

12.2 In addition, guest information may be disclosed as required by law, court order, or any other government or statutory authority.

12.3 Ashirwad Holidays may send transactional and promotional communications via SMS, email, WhatsApp, or phone calls, to provide updates on your tour status, new promotions, festive greetings, and other offers. By booking a tour/package, you consent to this usage of your personal data for communication with relevant third parties as described.

13.4 We reserve the right to use guest testimonials, emails, on-tour photos, video clips, and social media posts tagged to Ashirwad Holidays for promoting tours, packages, and destinations on various media platforms, without seeking further consent or compensation.

12.5 Ashirwad Holidays may also provide a reference, on request, to potential guests to promote our business.

12.6 Confidentiality : Information related to Ashirwad Holidays, our group companies, employees, partners, agents, and guests is confidential and remains the property of Ashirwad Holidays. This information will only be disclosed as required by law or necessary for the proceedings of the tour.

13.0 General Terms

13.1 Changes in Terms and Conditions : Ashirwad Holidays reserves the right to revise these Terms and Conditions periodically, with updates published on our website. Guests should check these terms regularly. By continuing to use the website after any revisions, you are deemed to accept the updated terms. The most recent version of the Terms and Conditions will override any previous versions.

13.2 Only the company, in writing, has the authority to modify or waive any part of these Terms and Conditions. Neither employees nor partners have the authority to make such changes. Any assurances given by employees or agents outside of these Terms and Conditions hold no effect.

13.3 Enforceability : Should any provision of these Terms and Conditions be deemed invalid, it will be modified to align with applicable laws while maintaining the original intent of Ashirwad Holidays. Other provisions not held invalid will continue to remain in force.

13.4 No Prejudice to Consumer Rights : If you are a guest acting in a private capacity (not associated with a business or profession), your consumer rights remain unaffected by these Terms and Conditions to the extent that they cannot be excluded or limited by law.

13.5 Jurisdiction : This agreement is governed by Indian law. All disputes arising from the tour/package/service will be subject to the jurisdiction of courts in Gorakhpur (Uttar Pradesh), India.

13.6 Complaint Procedure & Consumer Protection: For queries, concerns, or issues during the booking or tour, guests should promptly inform their Ashirwad Holidays Travel Advisor or Tour Manager. For customized holidays, guests should contact their guest relations representative. If issues remain unresolved, guests should call our guest relations emergency number or email enquiry@ashirwadholidays.in, providing their booking reference and relevant details. Any unresolved matters must be reported within 30 days after the tour/service’s completion for consideration. Claims made after this period will not be accepted.

13.7 Applicable Law and Dispute Resolution: Ashirwad Holidays aims to resolve disputes amicably. Guests and Ashirwad Holidays agree to attempt good-faith negotiation of any disputes, providing written notice and a brief description of the issue. If a solution is not reached within 60 days, either party may pursue legal proceedings through the Consumer Redressal Commission or Court. Legal notices should be sent to Ashirwad Holidays’ corporate office.

13.8 Arbitration: Disputes arising from these terms, agreements, or their validity will be referred to an Arbitral Tribunal with a sole Arbitrator, mutually agreed upon by both parties, with no relation to either party. The proceedings will be conducted in English in Gorakhpur.

13.9 Indemnification: Guests agree to fully indemnify Ashirwad Holidays for any legal actions, claims, or demands arising from their participation in the tour.

13.10 Disclaimer of Warranties: By using our services, you agree that this usage is at your own risk. All products and services provided are “as is” without any warranty or guarantee. Ashirwad Holidays makes no warranties regarding the uninterrupted, timely, secure, or error-free nature of its services.

13.11 Attorney/Client Fees: If a guest is unsuccessful in a legal action against Ashirwad Holidays, they must cover all related legal costs, including attorney/client fees.
